opt out to opt in for overtime

It is unlawful for an employer to subject a worker to a detriment because they have asserted a right under the Working Time Regulations. However, in a recent case it was held that an employer's policy of insisting that employees had to sign an opt-out agreement before being entitled to do overtime work was not a detriment but a reasonable means to ensure compliance with the regulations.
